Terms of Your Lease

In consideration of the monies received and the mutual promises contained herein, the Owner of the subject Property, through Shoreline OBX, his agent, does hereby lease and rent to Tenant that certain Property described above, under the following terms and conditions including all terms and conditions of the North Carolina Vacation Rental Act. Shoreline OBX, as agent for the Owner, is representing the interest of the Owner in this transaction.

This reservation request is being held for 48 hours, pending receipt of your advanced payment. Upon our receipt of your advanced payment, along with a copy of this Agreement signed by you, your reservation request will be converted to a confirmed reservation. Also note: The first half of the total, plus the total amount for the optional travel insurance, will be due within 48 hours. Balances are due in full 30 days prior to your arrival.

PAYMENT TERMS: A valid credit card (Visa, Master Card or Discover ONLY) is required with NO exceptions even if paying by check, cash or money order. Check or money order should be made out to Shoreline OBX. The Optional Travel Insurance can be purchased and added to your total. If you would like to opt-in, initial to purchase in section 29 below.


1. RATES: Rates and applicable taxes are subject to change.

2. ADVANCE PAYMENT: First half of the total amount and this signed lease agreement must be returned to Shoreline OBX within 48 hours of the date you communicated to the agent to reserve the Property.

If lease agreement and advance payment are not returned to Shoreline OBX, within the allotted time, the reservation will be automatically canceled without notice. A copy of the fully executed lease as Tenants receipt for the advance payment will be returned to the leaseholder.

3. BALANCE DUE, including taxes, and any and all fees for goods or services as shown on the Account Summary page, must be received by Shoreline OBX, 30 days prior to arrival. If the balance is not received 30 days prior to arrival, Shoreline OBX shall have the right, without further notification, to automatically charge remaining balance to credit card on file. Acceptable forms of payment include; personal check, cashiers check, or approved credit cards. NO PERSONAL OR COMPANY CHECKS WILL BE ACCEPTED WITHIN THE 30 DAY PERIOD PRIOR TO CHECK IN. A $25.00 handling fee will be charged for all returned checks. For reservations made less than 30 days from check in, all funds, or TOTAL, as shown above, are due immediately. ALL RESERVATIONS MUST BE PAID IN FULL PRIOR TO, CHECK IN AND POSSESSION OF THE PREMISES.

4. ALL ADVANCE RENT PAYMENTS AND BALANCES ARE DEPOSITED IN SHORELINE OBX TRUST ACCOUNT AT Towne Bank IN Kitty Hawk, NC. ADVANCE RENT PAYMENTS MAY BE DISBURSED TO OWNER OF UP TO FIFTY PERCENT (50%) OF THE RENTAL AMOUNT WHEN SUCH DISBURSAL IS OCCURRING MONTHLY. The balance of the funds after disbursal of advance rent payment may be disbursed upon commencement of the tenancy, a material breach of the agreement or other occurrence set forth in Section 42A-16(a) of the Vacation Rental Act, except administrative fees which may be disbursed upon receipt.

5. TAXES, as required by North Carolina, include the collection of Sales and Use Tax on all fees for goods and services charged to Tenants and a Lodging Tax on the rental rate. Taxes are subject to change. Taxes will be disbursed upon termination of tenancy or a material breach of this agreement.

6. PETS: DOGS ONLY are permitted in pet friendly properties. Violation is a material breach and is grounds for immediate EVICTION. NO EXCEPTIONS - NO REFUNDS. For those designated properties that do allow dogs, there is an additional non-refundable fee. Dogs shall be limited to two (2) domestic, housebroken, nondestructive adult dogs (no puppies). Local Government regulations regarding dogs change constantly. Some do not allow dogs on the beaches at all and others only in the off season. Please clean up after your dogs, which includes keeping dogs off all furniture and bedding. If you DO NOT clean up after your dog(s), including interior and exterior of the property, there will be a charge of $150.00 charged to your credit card on file after departure.

8. UNIT FOR SALE: Tenant understands vacation rental property may be listed for sale. Agent reserves the right to show each rental unit for sale to potential buyers. Every effort will be made to schedule the showing so that there is minimal interruption to the tenant's vacation. Tenant understands in the event of sale or transfer of the subject property, the new owner may not be bound to honor this rental. In this event, the tenant shall be entitled to a refund of rental payments made. The sale or transfer of the property is subject to NC GS42A, Vacation Rental Act.

9. FAMILY GROUPS ONLY Shoreline OBX is authorized, through their contract with the Owner, to rent only to family groups. The tenant shown above acknowledges that he/she is at least 25 years old and understands that he/she must personally occupy the property for the entire period. Tenant further acknowledges he/she MAY NOT rent the property in connection with a non-family use such as high school, college or civic groups and to do so constitutes a material breach which would be grounds for immediate EVICTION. NO EXCEPTIONS - NO REFUNDS. PROPERTIES ARE PATROLLED ON A REGULAR BASIS. N.C. GEN. STAT. 14-100 MAKES IT A CRIME TO OBTAIN THIS RENTAL UNIT UNDER FALSE PRETENSES.

10. MAXIMUM OCCUPANCY, as shown above, must not be exceeded. Occupancy count does not include children under the age of 3 years old. The hosting of parties, which would increase maximum occupancy in the home, on decks, stairs or anywhere on the property, is a violation of your rental lease. OVER OCCUPIED PROPERTIES CONSTITUTES A MATERIAL BREACH AND ARE SUBJECT TO IMMEDIATE EVICTION. NO REFUNDS, NO EXCEPTIONS. In witness whereof, this agreement is executed by each party hereto. Tenant acknowledges and accepts all terms as set forth on both sides of this agreement, and the rules and regulations on the attached page. Tenant also acknowledges that agent is representing the Property Owner of each home in the rental program.

11. TERMINATION - If Tenant or any member of his party violates any of the terms of this agreement, then Agent may, at Agents sole discretion, terminate this lease with no refund of the unused portion of the rents and may enter the premises and remove Tenant, the members of his party and their belongings. The North Carolina Vacation Rental Act contains provisions regarding an expedited eviction procedure pursuant to North Carolina General Statute Section 42A-23 et sec. Any material breach as set forth herein will entitle the Owner and/or Agent to apply for the expedited eviction procedures. A material breach shall include, but not be limited to, damage to the property, or failure to check out on a timely basis.

12. CANCELLATIONS must be made in writing and received by Shoreline OBX prior to check in. Refunds are available if the property is re-rented. The tenant is responsible for verifying that the cancellation letter has been received by Shoreline OBX. If Shoreline OBX is unable to re-rent the property, any and all prepaid rental payments, administrative fees, and taxes due will be forfeited. If the property is re-rented for the full term of the original rental period at the full rental rate, Tenant will receive a refund of any prepaid rental payment, less a service charge of $150.00. The agent may, in its sole and absolute discretion, reduce the rental amount without notice. If the property is re-rented for only a part of the original rental period, or if the week is re-rented at a discounted rate, the difference in rent will be subtracted from the original Tenants' refund, and a $150 service charge will be applied as well. If the tenant has purchased the Travel Insurance, the premium is non-refundable. Refunds will be payable to the Tenant within 30 days after the subsequent re-rent payment has cleared our accounts. Tenant will be entitled to reimbursement of any fees paid to Agent for goods, services, or benefits procured by the Agent from third-parties for the benefit of Tenant that have not been paid out prior to Shoreline OBX, LLC. receiving the written notice of cancellation. TRAVEL INSURANCE IS HIGHLY RECOMMENDED TO PROTECT AGAINST UNEXPECTED EVENTS.

13. TRANSFERS by the tenant may be made from one week to another within the same property only and must be within the same calendar year. All requests for transfers must be made in writing and received by Shoreline OBX at least 60 days prior to check in. Transfers which occur from a higher rental rate season to a lower rental rate season will remain at the charge of the higher rental rate season. Transfers from a lower rental rate season to a higher rental rate season will be charged the higher rental rate. There will be a $95.00 transfer fee plus tax, due with every week transferred and all payments will be due as specified in Paragraph 2.

14. TENANT OBLIGATIONS: The tenant use of the Property is for You and Your family The term "family" as used herein means parents, grandparents, children and extended family members vacationing at the Property. Use Of the Property by Groups Under 25 Years of Age Is Strictly Prohibited. A valid ID may be required prior to and/or at Check in and must be submitted to Agent upon request. Occupancy shall not exceed the maximum number allowable by law. You agree to comply with all obligations imposed on You by the North Carolina Vacation Rental Act with respect to maintenance of the Property, including but not limited to, the following: (a) keep the Property as clean and safe as the conditions of the Property permit, and cause no unsafe or unsanitary conditions in the common areas and remainder of the Property that You use; (b) dispose of all trash and other waste in a clean and safe manner; (c) keep all plumbing fixtures in the as clean as their condition permits; (d) not deliberately or negligently destroy, deface, damage, or remove any part of the Property or render inoperable the smoke detector, carbon monoxide detector or pool alarm. Please notify Agent if there is a need of replacement of batteries and or repairs of devices if not working properly (e) comply with all obligations imposed upon the Tenant by current applicable building and housing codes; (f) be responsible for all damage, defacement, or removal of any property inside the Property that is in Your control unless the damage, defacement, or removal was due to ordinary wear and tear, acts of the Owner or Owner’s Agent (g) smoking, including e-cigarettes, is not permitted in all Properties. (h) fireworks of any nature whatsoever are strictly prohibited. (i) Rearranging of furniture is not permitted. You agree not to use the Property for any activity or purpose that violates any law or governmental regulation and may use the Property for residential purposes only. Your breach of any duty contained in this paragraph after commencement of tenancy shall be considered material, and shall result in the termination of Your tenancy with no refund of rent.

15. Non Accidental DAMAGES to the Property during the occupancy must be reported to Shoreline OBX immediately and paid for prior to departure. If the cost of the damages is undeterminable by the time of departure, the Tenant shall remain responsible for such costs and agrees the credit card on file will automatically be charged for the assessed amount.

16. INSPECTION AND REPAIRS to property, its fixtures, appliances, furnishings, and facilities during the rental period may be made by Owner, Agent or Agents representative during the rental period.

17. CHECK IN to our office between 9:00 am and 5:00 pm. Access to the actual rental BEGINS at 4:00 P.M. In extreme situations check in time may need to be extended for additional cleaning and regular maintenance. Tenant shall not be on the Property, including driveways, prior to checking in. TENANT MAY BE CHARGED UP TO AN ADDITIONAL ONE (1) DAY RENTAL IF PROPERTY IS OCCUPIED PRIOR TO CHECK IN.

18. CHECK OUT on the day of departure will be no later than 10:00 A.M from property. Tenant must return keys to the office on check out day, unless the property has a keyless entry. No occupancy of the property, including driveways, after check out will be allowed. TENANT MAY BE CHARGED UP TO AN ADDITIONAL ONE (1) DAY RENTAL IF PROPERTY IS OCCUPIED AFTER CHECK OUT.

19. MISCELLANEOUS: Agent may accept commissions from independent businesses for goods and services pertaining to the property or the tenancy, such commissions were based on a percentage of the total charge.


LIMITATIONS OF REMEDIES, DAMAGES, AND INDEMNITY:

20. Occasionally, some pools in Dare & Currituck Counties may experience a mild ground current. Generally, this is not caused by a pool defect or the household electrical system but appears as a result of the earth’s own natural electrical current. Certain properties may be affected more than others and the current tends to be intermittent in nature. Please be advised, however, that this may affect the operation of pacemakers and other similar devices; Due to the possibility of accident or injury, Agent prohibits children from using hot tubs. Also, the chemicals used to keep hot tubs sanitary may cause fading in some swimsuits and some individuals may experience mild skin rashes. For your safety, chemical dispensers shall not be removed at any time.

21. In the event that the Owner is unable to allow the Tenant the use of said Property because of fire, eminent domain, double-booking, delay in construction, Tenant hereby agrees that Agent and Owners sole liability as a result of any such condition is a refund of the prorated rental for each day Tenant is unable to use the Property.

22. Tenant understands that there are inherent risks associated with any property, including risks associated with any special feature, such as a spa, hot tub, sauna, Jacuzzi, pool, elevators, etc. Tenant certifies that they are thoroughly familiar with how to properly use the premises, including all special features included therein or thereon. Tenant will be responsible for explaining how to use each and every feature of the dwelling to Tenants guests. Tenant agrees to release and indemnify the Owner and his Agent from and against all liability, should anyone be injured upon the premises during the term of this lease, resulting from any cause whatsoever, except in the case of a personal injury caused by the negligent act of the Owner or his Agent or Agents employees, and Tenant further agrees to indemnify and save harmless Owner and/or his Agent and Agents employees from any claims made by Tenant or Tenants guest for injury or liability to person or property. Tenant further agrees that Tenant is responsible and liable for and will pay upon request, any damages that occur to the premises or any portion thereof due to Tenants and/or his guest's misuse and/or negligent use of the premises or any portion thereof. Agent prohibits children from operating elevators. Guests will be responsible for the cost of any negligent service calls.

23. Tenant shall not be entitled to any refund or rebate due to acts of nature, mandatory evacuations, delay in check in, unfavorable weather, disruption of utility services, malfunctioning or missing equipment/appliances/furnishings, surrounding construction and associated noise, empty propane gas cylinders for fireplaces or gas grills, or insufficient work from outside vendors or any other situation occurring not under Agents control. Tenant shall not be entitled to any refund or rebate for cleaning issues. Every effort will be made by Agent to rectify any cleaning issues within 24 hours. Tenant covenants and agrees to vacate upon a mandatory evacuation order or if Agent in Agents sole discretion, deems it in the best interest of the Tenant to vacate. TRIP CANCELLATION INSURANCE IS HIGHLY RECOMMENDED TO PROTECT AGAINST THE ABOVE AND OTHER UNEXPECTED EVENTS. Shoreline OBX will not be responsible for any parking or towing charges that may be incurred by tenants. Unnecessary elevator charges that are incurred as a result of failure to follow elevator instructions will be the responsibility of the tenant. Negligent service calls, will automatically be charged to the credit card on file.

24. Every effort has been made to ensure that the information in this agreement and on our website is accurate. However, we will not be responsible for any errors contained herein. Due to possible changes in the bedding, amenities, and pricing, please check www.ShorelineOBX.com for the most up-to-date on the rental property prior to signing the lease. Private pools opening dates vary by unit.

25. Properties represented may be owned by a North Carolina Real Estate Broker or Salesman or a licensee of another State. f ) If the Property is voluntarily transferred by the Owner, a Tenant has the right to enforce this agreement against the Grantee of the Property if the vacation rental is to end one hundred eighty (180) days or less after the date the Grantees interest in the Property is recorded; if the vacation rental is to end more than one hundred eighty (180) days after recordation of the Grantees interest in the Property, the Tenant has no right to enforce the terms of this agreement unless the Grantee agrees in writing to honor this agreement. If the Grantee does not honor this agreement, the Tenant is entitled to a full refund of any payments made. Upon such a transfer, you the Tenant will be notified as to your rights. Upon any transfer of the Owners interest, whether voluntary or involuntary, you will be notified as to all disbursements, if any, of any monies paid by you.

26. NON-SMOKING - ALL Shoreline OBX properties are non-smoking. Smoking in a property will result in expedited eviction without refund. A minimum charge of $250 will be incurred for noncompliance as well as any additional cleaning charges or damages. Cigarette butts left on the property will incur a $250.00 fine and be charged to your credit card on file.

27. CLEANING: TENANT MUST LEAVE PROPERTY TIDY. ALL DISHES WASHED AND PUT AWAY, ALL FOOD REMOVED FROM REFRIGERATOR, ALL TRASH REMOVED FROM HOME, FLOORS SWEPT, AND BBQ GRILL CLEANED PRIOR TO DEPARTURE AT CHECK OUT. Failure to do so will result in an automatic additional charge of $200.00 for 3-4 bedrooms, $300.00 for 5-6 bedrooms, $400.00 7-8 bedrooms and $500.00 for 9 and up to your credit card on file, without prior notification.

28. DISPUTES: This Lease shall be governed by and interpreted in accordance with the law of the State of North Carolina, and shall be treated as though it were executed in the County of Dare, State of North Carolina. Any action relating to this Lease shall only be instituted and prosecuted in courts in North Carolina. Lessee specifically consents to such jurisdiction and to extraterritorial service of process. In the event of litigation involving the provisions of this Agreement, the prevailing party will be entitled to an award of attorney fees.

29. TRAVEL INSURANCE: Is offered to our guests and is intended to protect tenant' travel investment in the event of unforeseen circumstance which would cause cancellation. This coverage is OPTIONAL. The cost of the travel insurance is 6.95% of the total amount of your reservation. Coverage will begin 24 hours after your payment is received by Shoreline OBX.
